1. Acceptance of Terms
By downloading, installing, or using the Viviq mobile application or visiting viviq.co (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Viviq is an AI-powered photo analysis service that provides:
- Viral potential scoring and performance predictions
- AI-generated caption suggestions
- Hashtag strategy recommendations
- Pose and composition analysis (paid plans)
- Photo comparison (Starter+)
- AI visual generation (Pro plan)
Viviq's predictions are AI-generated estimates and do not guarantee any specific social media performance.
3. Account Registration
You must create an account to use the Service. You agree to: (a) provide accurate information; (b) keep your credentials secure; (c) notify us immediately of any unauthorized account access. You are responsible for all activities under your account.
4. Subscriptions, Credits, and Payments
4.1 Free Plan
New users receive 10 complimentary analysis credits. Free credits are non-transferable and non-refundable.
4.2 Paid Subscriptions
Paid subscriptions are billed monthly or annually via Apple App Store or Google Play. Prices are displayed at the time of purchase.
4.3 Credit Packs
Additional credits can be purchased as one-time in-app purchases. Credit packs do not expire and are non-transferable.
4.4 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
5. Acceptable Use
You agree not to:
- Upload photos containing illegal content or content that violates third-party rights
- Reverse-engineer or attempt to extract the source code of the Service
- Use automated tools or bots to access the Service
- Resell or commercially exploit the Service without written permission
- Upload photos you do not own or have rights to use
6. Intellectual Property
6.1 Your Content
You retain ownership of photos you upload. By uploading, you grant Viviq a limited, temporary license to process the photo solely to provide the Service. This license ends when processing is complete.
6.2 AI-Generated Content
Captions and hashtags generated by our AI are provided for your use. Viviq makes no guarantees about their originality or suitability.
6.3 Viviq IP
The Viviq name, logo, app design, and AI models are owned by Viviq. Nothing in these Terms grants you a right to use our trademarks.
7. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.
8. Termination
You may terminate your account at any time by contacting support@viviq.co. We reserve the right to suspend or terminate access for Terms violations.
9. Changes to Terms
We may update these Terms at any time. Material changes will be communicated at least 14 days before taking effect. Continued use constitutes acceptance.
